1. Acceptance of Terms
By accessing gotmaple.ca or using GotMaple's services, you agree to be bound by these Terms of Use and our Privacy Notice (PIPEDA). If you do not accept these terms, please do not use our platform.
2. Eligibility
You must be 18 years of age or older, or have parental consent, to create an account or make purchases on GotMaple. Our platform is available to Canadian residents only.
3. Account Registration
You must provide accurate and complete information when registering. You are responsible for keeping your password secure and for all activity under your account. Report any unauthorized access immediately to support@gotmaple.ca.
4. Seller Obligations
As a seller on GotMaple, you agree to comply with all of the following obligations:
- •Maintain an active Canadian bank account (OSFI-regulated institution or provincial credit union) to receive payments via Stripe Connect direct deposit.
- •Respond to all buyer inquiries and GotMaple communications within two (2) business days.
- •Provide accurate, complete, and non-misleading product descriptions, including country of origin, materials, dimensions, and any applicable safety warnings.
- •Comply with all applicable federal and provincial tax laws, including CRA rules regarding GST/HST and QST, and maintain required accounting records.
- •Ship orders within the timeframe stated in your listing and provide a valid tracking number upon shipment.
- •Only list items you have legal authority to sell and that do not infringe third-party rights.
5. Buyer Obligations
As a buyer on GotMaple, you agree to:
- •Provide an accurate and complete shipping address at the time of order. GotMaple and the seller are not responsible for delays or missed deliveries resulting from an incorrect address.
- •Pay promptly and in full at the time of order. Non-payment or fraudulent chargebacks may result in account suspension.
- •Use the platform only for personal, non-commercial purposes unless expressly authorized by GotMaple.
- •Submit honest reviews based on your genuine experience with the product or seller.
6. Prohibited Uses
It is strictly prohibited to use GotMaple for fraud, to sell counterfeit or illegal items, or to propagate hate speech. Any account found in violation will be suspended or terminated without notice.
7. Purchases & Payments
All prices are displayed in Canadian dollars (CAD). Applicable taxes are collected according to the delivery province, in compliance with CRA rules. Orders are subject to seller inventory availability. Payments are processed by Stripe, a globally trusted PCI-DSS Level 1 certified payment processor.
8. Intellectual Property
GotMaple™ and the maple leaf logo are registered trademarks of GotMaple.ca Inc. By posting content on our platform, you grant GotMaple a non-exclusive licence to display it for commercial purposes related to your listing.
9. Limitation of Liability
GotMaple acts as a platform intermediary only. To the fullest extent permitted by the laws of British Columbia:
- •GotMaple is not liable for seller actions, product defects, or shipping delays or losses.
- •GotMaple's total aggregate liability to you shall not exceed the amount paid for the transaction in question during the preceding twelve (12) months.
- •GotMaple shall in no event be liable for indirect, incidental, special, or consequential damages.
10. Dispute Resolution
We encourage good-faith resolution of any dispute. If agreement cannot be reached, the following process applies:
- •Disputes of CAD $35,000 or less: you may file a claim with the British Columbia Civil Resolution Tribunal (CRT) or BC Small Claims Court, as applicable.
- •Disputes exceeding CAD $35,000: the parties agree to submit the dispute to binding arbitration under the commercial arbitration rules of British Columbia, seated in Vancouver, BC.
- •These dispute resolution provisions do not limit your right to file a complaint with a competent Canadian regulatory authority.
11. Governing Law
These terms are governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada. The parties submit to the exclusive jurisdiction of the courts of Vancouver, British Columbia for any dispute not subject to the arbitration provisions above.
12. Privacy & PIPEDA
GotMaple collects and processes your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for Quebec residents, in compliance with Law 25 (An Act to modernize legislative provisions as regards the protection of personal information). 13. CASL — Marketing Communications
GotMaple complies with Canada's Anti-Spam Legislation (CASL) for all commercial electronic messages (CEMs). The following rules apply:
- •We will only send commercial electronic messages (promotional emails, sale notifications, etc.) to individuals who have provided express or implied consent under CASL.
- •Every commercial message includes a functioning unsubscribe mechanism. Unsubscribe requests are processed within ten (10) business days, as required by CASL.
- •Transactional messages (order confirmations, shipping updates, password resets) are not CEMs and do not require explicit consent.
- •Sellers using GotMaple's messaging tools to contact buyers must also comply with CASL. GotMaple may suspend access to messaging tools for violations.

14. Consumer Protection
GotMaple complies with applicable provincial consumer protection legislation across all Canadian provinces and territories, including:
- •British Columbia: Business Practices and Consumer Protection Act (BPCPA) — protection against unfair business practices, right to refund for non-delivery.
- •Ontario: Consumer Protection Act, 2002 — disclosure requirements for internet and distance contracts.
- •Quebec: Consumer Protection Act (LPC) — 7-day cancellation right for distance contracts, mandatory CAD price display.
- •Alberta: Consumer Protection Act — prohibition of deceptive trade practices and protection against undisclosed charges.
- •All other provinces and territories: GotMaple complies with equivalent legislation applicable in all other Canadian provinces and territories.
These rights apply independently of other provisions in these terms. Where any term conflicts with applicable provincial consumer protection law, the provincial law prevails.
15. Changes to Terms
GotMaple will provide 30 days' notice of material changes via email before they take effect. Continued use of the platform after that period constitutes acceptance of the updated terms.
